Only if the insurance can prove it crashed because it wasn't in annual.
When I was an adjuster if the plane wasnt in annual no claim! We never cared WHY a loss happened (at the adjuster level) we just paid claims... if the plane isn't airworthy it (usually) isnt insurable!
